Principle of proportionality

The proportionality principle is used to determine the redundancy criteria in the event of reorganisation or mass redundancy. This principle involves dividing employees with similar jobs into age groups and looking at which employee was hired last in each age group. This person is first eligible for dismissal.

Since 1 April 2014, the Dismissals Decree has changed the principle of proportionality. Workers with a state pension will be laid off on a priority basis.
