offer and acceptance

According to Dutch law an agreement comes into being by offer and acceptance of that agreement. Offer and acceptance is the main requirement for the formation of a contract in the Netherlands. It is one of the most important principles in Dutch contract law.

Contractual formation in the Netherlands

The acceptance must substantially meet the offer. If the acceptance differs only on minor issues from the offer, an agreement will come into being according the acceptance. When the offerer has immediately objected, however, the agreement will not be concluded.
